Abstract

A fenntarthatóság napjainkban új paradigmaként jelenik meg a jogtudományban is. A gazdasági, környezeti, és társadalmi fenntarthatóság mellett a jog fenntarthatóságáról, és a fenntarthatósági jogról is szükséges gondolkodni. A jog és a fenntarthatóság kapcsolata nem érthető meg a házasság, a család, a magántulajdon, az állam kialakulása, kezdetei, szerepük ismerete nélkül. Az állam a nemzetségekké vált családokra épült. A család kiemelkedő szerepet töltött be a tulajdoni viszonyok területén a társadalom és a gazdasági rendszer alapegységeként. Az állammá alakulás döntő motívuma a tulajdon védelme volt.
